Terms of Use

Effective date: July 26, 2026
Last updated: July 26, 2026

These Terms of Use (“Terms”) govern your access to and use of DamnGoal, a goal, habit, task, and AI companion for iOS and Android. DyvenTech LLP (“DamnGoal,” “we,” “us,” or “our”) operates the DamnGoal mobile application, website at https://damngoal.app, API, and related services (together, the “Service”).

By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 13 years old in the United States, at least 16 years old in the European Economic Area (“EEA”), or at least the higher minimum age required by the law where you live.

If you have not reached the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf. You may not use the Service if applicable law prohibits you from receiving it.

If you use the Service for an organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” includes the organization.

2. Your account

You must provide accurate information and keep it current. You are responsible for:

  • safeguarding your device, email account, sign-in credentials, and authentication codes;
  • activity that occurs through your account, except to the extent caused by our breach of these Terms or applicable law; and
  • notifying us promptly at appsupport@dyven.tech if you suspect unauthorized access.

You may not sell, transfer, share, or allow another person to use your account. We may require you to verify your identity or account information to protect the Service or respond to a legal request.

3. The Service

DamnGoal helps you create and manage goals, habits, tasks, schedules, check-ins, reflections, focus sessions, progress history, and related planning information. The Service may also include:

  • Companion, which provides AI-generated suggestions and drafts;
  • Witness, which lets you publish selected goal information and react to public content;
  • notifications, reminders, insights, and recaps; and
  • paid features or subscription plans.

We may add, change, suspend, or remove features. We will give notice when a change materially reduces a paid feature during an active subscription period and applicable law requires notice or a remedy.

The Service may require a compatible device, internet access, third-party account, current software, or an app update. Your mobile carrier or internet provider may charge data or other fees.

4. License to use DamnGoal

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your own lawful, non-commercial purposes.

This license does not transfer ownership of the Service or any DamnGoal software, design, content, trademark, or technology. We and our licensors reserve all rights not expressly granted to you.

You may not:

  • copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Service;
  • reverse engineer, decompile, disassemble, or attempt to extract source code, except where applicable law permits that activity despite this restriction;
  • bypass or interfere with access controls, security features, rate limits, or technical restrictions;
  • use automated means to scrape, harvest, or access the Service without our written permission;
  • use the Service to build or train a competing product or model;
  • introduce malware or harmful code; or
  • remove copyright, trademark, or proprietary notices.

5. Acceptable use

You may not use the Service to:

  • violate a law, regulation, court order, or another person’s rights;
  • threaten, harass, abuse, defame, impersonate, or deceive anyone;
  • publish unlawful, hateful, sexually exploitative, or violent content;
  • exploit or endanger a child;
  • send spam, conduct fraud, or distribute malicious or misleading material;
  • obtain unauthorized access to an account, system, or network;
  • interfere with other users or the operation of the Service;
  • publish another person’s confidential or personal information without lawful authority; or
  • encourage or help another person do any of the above.

We may investigate suspected violations and remove or restrict content or accounts when reasonably necessary to enforce these Terms, protect users, comply with law, or preserve the Service.

6. Your content

“Your Content” means information you submit to the Service, including goals, descriptions, habits, tasks, journal entries, Companion messages, usernames, public Witness content, reactions, feedback, and support communications.

You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, transmit, display, and otherwise process Your Content only as needed to:

  • operate, secure, and improve the Service;
  • provide features you request;
  • publish content you choose to share through Witness;
  • enforce these Terms; and
  • comply with law.

This license lasts while Your Content remains in the Service and for a reasonable technical period afterward for backups, security records, and legal obligations. The license ends when the relevant content is deleted, except where continued processing is legally permitted or required.

You represent that you have the rights needed to submit Your Content and grant this license. You are responsible for Your Content and for deciding what information to enter.

7. Witness and public content

Goals and journal content are private by default. When you publish content through Witness:

  • other signed-in users may see your username, public goal summary, and reactions;
  • other users may interact with that content through available features; and
  • you instruct us to display and distribute that content as part of the Service.

Do not publish information you want to keep private. Making content private or deleting it removes it from public display, although cached copies may take a short time to disappear.

We may moderate, restrict, or remove public content that violates these Terms or creates a legal, safety, or operational risk. We do not undertake to review every item before publication. If you believe public content violates these Terms, contact appsupport@dyven.tech.

8. AI Companion

Companion uses artificial intelligence to generate suggestions and drafts from your request and relevant account context. AI output may be inaccurate, incomplete, outdated, or unsuitable for your circumstances.

You must review AI output before relying on or acting on it. Companion does not provide medical, mental-health, legal, financial, tax, or other professional advice. It is not an emergency service and must not be used to make high-risk decisions where an error could cause death, injury, financial loss, loss of legal rights, or other serious harm.

You remain responsible for your goals, decisions, actions, and use of AI output. Do not submit content that you do not have the right to process or that you are not comfortable having processed as described in our Privacy Policy.

9. Subscriptions and purchases

Some features require a paid subscription. The price, billing period, included features, trial terms, and applicable taxes are shown before purchase.

9.1 Automatic renewal

Subscriptions renew automatically for the same billing period unless you cancel before renewal. The applicable app store charges your selected payment method. Renewal timing and notice follow the rules of the store through which you subscribed and applicable law.

9.2 Trials

If we offer a free or discounted trial, the offer will state its duration and eligibility rules. Unless you cancel before the trial ends, the subscription converts to a paid subscription at the disclosed price. A store may limit how often you can use a trial.

9.3 Cancellation

Manage or cancel a subscription through the Apple App Store or Google Play account used to purchase it. Cancellation normally takes effect at the end of the current paid billing period unless the store states otherwise.

Deleting the app or your DamnGoal account does not cancel a subscription. Cancel the subscription separately through the applicable store.

9.4 Refunds and price changes

Apple or Google processes store purchases, cancellations, and refunds under its applicable terms and refund policies. Except where applicable law or the store’s policy requires otherwise, charges are non-refundable and we do not provide credits for a partially used billing period.

Subscription prices may change. The applicable store will provide any notice or request any consent required by its rules or applicable law. You may cancel before a new price takes effect.

10. Privacy

Our Privacy Policy explains how we collect, use, disclose, and retain personal information. By using the Service, you acknowledge that we will process information as described in that policy.

11. Third-party services

The Service may rely on or link to third-party products and services, including Google, Apple, Google Play, Cloudflare, PostHog, Adapty, Tenjin, Brevo, and Google Cloud Vertex AI. Third-party services may have separate terms and privacy policies.

We do not control third-party services and are not responsible for them. Your use of a third-party service is governed by your agreement with that provider. You must comply with applicable third-party terms when using DamnGoal, including your device, app-store, network, and sign-in-provider terms.

12. Ownership and feedback

The Service, excluding Your Content, belongs to DyvenTech LLP or its licensors and is protected by intellectual-property laws. DamnGoal’s name, logos, product design, software, and related marks may not be used without our written permission.

If you send suggestions or feedback, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use, modify, publish, and commercialize that feedback without payment or attribution. This does not give us ownership of personal information contained in feedback.

13. Suspension and termination

You may stop using the Service at any time. You may delete your account through Profile → Account → Delete account or request deletion by emailing appsupport@dyven.tech from the address associated with your account.

We may suspend or terminate access if:

  • you materially or repeatedly violate these Terms;
  • your use creates a security, legal, or safety risk;
  • we must do so to comply with law or a binding order;
  • payment for a paid feature fails or is reversed; or
  • we discontinue the Service.

Where practical and legally permitted, we will give notice and an opportunity to correct the issue before termination. We may act immediately when delay could cause harm, expose us or others to liability, or compromise the Service.

On termination, your license ends. Sections that by their nature should survive will remain effective, including ownership, feedback, disclaimers, liability, dispute terms, and general provisions.

14. Disclaimers

Nothing in these Terms excludes a warranty, guarantee, remedy, or other right that applicable law does not allow us to exclude.

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement, and quiet enjoyment. We do not warrant that:

  • the Service will always be available, secure, or error-free;
  • data will never be lost;
  • reminders or notifications will arrive at a particular time;
  • AI output, insights, forecasts, or third-party content will be accurate or suitable; or
  • using the Service will produce a particular personal, professional, health, or financial outcome.

DamnGoal is a planning tool, not a substitute for professional advice, treatment, supervision, or emergency services.

15. Limitation of liability

Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer rights, or any liability that applicable law does not allow us to limit.

To the maximum extent permitted by law, DyvenTech LLP and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, business, opportunity, goodwill, or data, arising from or related to the Service.

To the maximum extent permitted by law, our total liability for all claims arising from or related to the Service will not exceed the greater of:

  • the amount you paid for the Service during the 12 months before the event giving rise to the claim; or
  • US$50 or its equivalent in your local currency.

These limitations apply regardless of the legal theory and even if a remedy fails its essential purpose. They do not reduce rights available under mandatory local law.

16. Indemnity

To the extent permitted by law, you will indemnify DyvenTech LLP against third-party claims, damages, and reasonable costs arising from:

  • Your Content infringing another person’s rights;
  • your unlawful use of the Service; or
  • your material breach of these Terms.

This obligation does not apply to the extent a claim results from our negligence, wilful misconduct, or breach of these Terms. We will give you reasonable notice of a covered claim and allow you to participate in its defense. You may not settle a claim in a way that admits fault by us or imposes an obligation on us without our written consent.

17. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to the paragraph below, the courts in Surat, Gujarat, India have exclusive jurisdiction over disputes arising from or related to these Terms or the Service.

If mandatory consumer law where you live gives you rights, remedies, governing-law protections, or access to local courts that cannot be waived by contract, those protections remain available to you. Nothing in these Terms requires a consumer to waive a mandatory right.

Before filing a claim, you and DyvenTech LLP agree to try to resolve the dispute informally for 30 days. Send a written description of the dispute and the requested resolution to appsupport@dyven.tech. Either party may seek urgent injunctive or protective relief without completing this informal process.

18. Apple App Store terms

This Section applies if you download or use DamnGoal through Apple’s App Store.

The Apple Licensed Application End User License Agreement (“Apple Standard EULA”) is incorporated into these Terms by reference and governs your license to the iOS application. These Terms supplement, and do not replace, the Apple Standard EULA. If there is a conflict concerning your license to the iOS application or Apple’s rights and obligations, the Apple Standard EULA controls.

You and DyvenTech LLP acknowledge that:

  • these Terms are between you and DyvenTech LLP, not Apple;
  • DyvenTech LLP, not Apple, is responsible for DamnGoal and its content;
  • Apple has no obligation to provide maintenance or support for DamnGoal;
  • the iOS license is non-transferable and limited to Apple-branded products that you own or control, subject to the usage rules in the Apple Media Services Terms and Conditions and any permitted Family Sharing, volume purchasing, or Legacy Contacts;
  • DyvenTech LLP, not Apple, is responsible for product claims, legal-compliance claims, and claims that DamnGoal infringes a third party’s intellectual-property rights;
  • you must comply with applicable third-party terms when using DamnGoal; and
  • Apple and its subsidiaries are third-party beneficiaries of this Section and may enforce it against you.

If the iOS application fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, for the application. To the maximum extent permitted by law, Apple has no other warranty obligation for DamnGoal. DyvenTech LLP remains responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty.

You represent that you are not located in a country or region subject to a United States Government embargo or designated by the United States Government as supporting terrorism, and that you are not listed on a United States Government prohibited- or restricted-party list.

19. Google Play terms

This Section applies if you download or use DamnGoal through Google Play.

Your use of Google Play is subject to the applicable Google Play Terms of Service. These Terms are between you and DyvenTech LLP, not Google. Google is not responsible for DamnGoal or for providing support for it.

Google Play may process purchases, renewals, cancellations, and refunds under its terms and policies. If these Terms conflict with mandatory Google Play terms concerning a Google Play transaction or your use of Google Play, the applicable Google Play terms control for that matter.

20. Changes to these Terms

We may update these Terms as the Service, our business, or the law changes. We will post the revised Terms at https://damngoal.app/terms/ and update the “Last updated” date.

If a change materially affects your rights, we will provide advance notice through the Service, by email, or by another reasonable method when required by law. Changes take effect on the stated effective date. If you do not agree to revised Terms, stop using the Service and cancel any subscription before the changes take effect.

21. General terms

  • Entire agreement. These Terms, the Privacy Policy, the Apple Standard EULA where applicable, and any purchase terms shown to you form the agreement between you and DyvenTech LLP about the Service.
  • Order of precedence. Mandatory law controls first. Platform terms control only for matters within the platform provider’s responsibility. These Terms control other matters involving the Service.
  • Severability. If a provision is unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.
  • No waiver. A delay or failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, sale of assets, or transfer of the Service, subject to applicable law.
  • No agency. These Terms do not create a partnership, joint venture, employment, fiduciary, or agency relationship between you and DyvenTech LLP.
  • Force majeure. We are not responsible for delay or failure caused by events beyond our reasonable control, subject to applicable law.
  • Electronic communications. You agree to receive contractual notices electronically. This does not affect any right to a non-electronic notice under mandatory law.
